Common use of ESTOPPEL/WAIVER Clause in Contracts

ESTOPPEL/WAIVER. A waiver of any performance or default by either party shall not be construed to be a continuing waiver of other defaults or non-performance of the same provision or operate as a waiver of any subsequent default or non-performance of any of the terms, covenants and conditions of this Agreement.
