European Funding and Other Sources of Funding. 22.1 Where notified in writing by the ESFA that the Funding under this Contract is required to be used as match funding: 22.1.1 The Contractor must follow the ESF Funding Rules for publicity, horizontal themes, surveys, reporting, evidence and document retentions and which include the use of the ESF logo. 22.1.2 The Contractor must not use the Funding paid under this Contract to support bids or claims that will be used to secure funding from any European source, either on its own behalf or on behalf of the ESFA, including but not limited to as match funding. 22.1.3 Where the Contractor or any of its sub-contractors has access to other funding streams, the Contractor or any of its sub-contractors will be required to demonstrate through accounting, management information systems and any other relevant evidence (in the sole discretion of the ESFA or any other body undertaking the audit or monitoring), to the ESFA and anybody set out in Clause 12.2 that no double funding has occurred in respect of the Services delivered under the Contract. 22.1.4 Where the ESFA identifies double funding in respect of the Services, or any part thereof, the Contractor will be liable to repay to the ESFA any sums paid, or part thereof, by the ESFA in respect of the Services for which the Contractor has received funding from another source and the ESFA reserves the right to deduct such sums from any monies owed to the Contractor under the Contract or any subsequent Contract. 22.1.5 The ESFA reserves the right to use payments made under the Contract as match funding for ESF projects. Where requested to do so in writing by the ESFA, the Contractor shall provide such information and in the form as the ESFA specifies to enable the ESFA to comply with the requirements of ESF. 22.1.6 The Contractor shall inform Apprentices or others that the Services delivered have been financed in whole or part by ESF. 22.2 The Contractor must ensure that all Apprentices are aware of the support of the ESF in respect of the Services being delivered under this Contract.

Learners must meet the eligibility criteria defined in the Operational Programme as well as the specific eligibility criteria set out in the Contract. 20.2 THE CONTRACTOR will comply with written requests by THE SFA to display the ESF logos and emblems on any materials relating to funding by the ESF. THE SFA will make available to THE CONTRACTOR all relevant ESF logos and emblems. 20.3 THE CONTRACTOR must ensure that all Apprentices Learners are aware of the support of the ESF in respect of the Services being delivered under this Contract. 20.4 THE CONTRACTOR shall complete the Non ILR participant data spreadsheet and/or Actual Costs claim form (available on xxxx://xxxxxxxxxxxxxxxxxxx.xxx.xxx.xx/providers/programmes/esf/) to substantiate data submitted on the delivery statement. THE CONTRACTOR shall submit this to THE SFA and Secretary of State through the Provider Gateway. 20.5 At any time during the delivery of any ESF funded programme provided under this Contract where THE CONTRACTOR is unable to provide the required evidence for any deliverable (as set out in the Evidence Requirements Table in the ESF Schedule(s) THE CONTRACTOR must write to THE SFA providing the reason(s) why they are unable to comply with the evidence requirements and giving full details of alternative evidence to be considered. THE SFA will review the request and notify THE CONTRACTOR in writing of any revisions to the evidence requirements which shall form part of the terms and conditions of the Contract. In all such reviews, the decision of THE SFA shall be final.

Where the ESFA identifies double funding in respect of the Services, or any part thereof, the Contractor will be liable to repay to the ESFA any sums paid, or part thereof, by the ESFA in respect of the Services for which the Contractor has received funding from another source and the ESFA reserves the right to deduct such sums from any monies owed to the Contractor under the Contract or any subsequent Contract. 22.1.5 23.1.5. The ESFA reserves the right to use payments made under the Contract as match funding for ESF projects. Where requested to do so in writing by the ESFA, the Contractor shall provide such information and in the form as the ESFA specifies to enable the ESFA to comply with the requirements of ESF. 22.1.6 23.1.6.
