Event Cancellation. NCSI and the Federal Government, in their sole discretion, reserve the right to cancel event(s) at any time without any liability for the fulfillment of this contract and all fees paid by Vendor shall, at the Vendor’s option, be fully refunded or credited for cancelled events scheduled (or rescheduled) to occur between January 1, 2024 and December 31, 2024. Credit card refunds shall be subject to a 3% administrative processing fee. Credits left on account shall remain valid until December 31, 2025 after which shall be considered fully earned by NCSI and non-refundable.
Event Cancellation. The safety of all attendees, volunteers, exhibitors, staff and sponsors is CF’s main concern. If for any reason, as directed by the South Australian Government or any other statutory authority, or for any reason outside of CF’s reasonable control, the Event is required to be cancelled or postponed, all Sponsors will be provided the choice of a full refund of monies paid or having that amount credited to the following DAL Expo event or equivalent.
Event Cancellation. 8.1. The Event will be held outdoors and could be adversely affected by weather and other unforeseen circumstances including but not limited to torrential rain, wind, lightning, flooding, excessive heat, fire, smoke, biohazard, pandemic, terrorism and other danger to life events and acts of god.
8.2. As the Organiser is a charitable organisation the Organiser shall accept no liability for cancellation of the Event at any time due to circumstances outside their control. Such cancellation will be based upon ensuring the safety, quality and wellbeing of the Sponsor and the general public. In the event of cancellation of the Event by the Organiser the Organiser shall provide refund of the Sponsorship Fees already paid less any costs that may have been incurred by the Organiser as a result of the cancellation. The Organiser shall have sole discretion as to whether any refund shall be provided to the Sponsor
Event Cancellation. In the event of cancellation or rescheduling at any time prior to or during the event for any reason, Housing First Minnesota may consider a refund if deemed appropriate, taking into consideration that a substantial portion of the expenses for the event are front-loaded, and that the Parade of Homes also is the primary funding source for the Housing First Minnesota’s activities. If member has not paid the event fee in full, Housing First Minnesota is entitled to recover from member all fees necessary to bring it to the same level as all other entrants.
Event Cancellation. 14.1 The Organiser reserves the right to cancel the Event for any reason (including, without limitation, by reason of a Force Majeure Event). The Organiser shall notify the Sponsor of the cancellation as soon as possible. The parties agree that:
14.1.1 the Organiser shall not be in breach of this agreement by virtue of that cancellation or abandonment and the Sponsor shall remain liable to make all payments in full to the Organiser;
14.1.2 on the Organiser notifying the Sponsor of such cancellation, this agreement shall automatically terminate and the provisions of clause 17 shall apply.
15.1 If the Organiser notifies the Sponsor that the Event is being rearranged or postponed to a different date or venue for any reason, the rights and obligations under this agreement shall remaining binding on the parties except for any amendments which are reasonably required to allow for any change in venue, dates or period of the Event, or the location of or space available at a changed venue.
Event Cancellation. (a) If for any reason the Event is postponed, the Customer’s booking for that Event will be valid for the re-scheduled Event (if any) save where such re-scheduled Event takes place at a location other than the original Venue.
(b) If for any reason outside the control of the Seller (including, without limitation, due to the circumstances set out in Condition 7.1) the Event is postponed, cancelled or abandoned (whether wholly or in part) any refunds shall be at the entire discretion of the Seller and the Customer is advised to take out its own insurance to cover such risks and associated costs.
(c) Play is not guaranteed and under no circumstances will any refund be made in respect of the purchases for hospitality packages. However, if a refund scheme for the ticket element of the package applies, then a small refund or ticket exchange may be applicable.
(d) Subject as expressly provided in these Conditions, and except where the Hospitality Package is sold to a person dealing as a consumer (within the meaning of the Unfair Contract Terms Act 1977), all warranties, conditions or other terms implied by statue or common law are excluded to the fullest extent permitted by law.
(e) Where the Hospitality Package is sold under a consumer transaction (as defined by the Consumer Transactions (Restrictions on Statements) Order 1976) the statutory rights of the Customer are not affected by these Conditions.
(f) Any complaints concerning the Hospitality Package must be notified to the Seller in writing as soon as reasonably practicable after the Event.
Event Cancellation. 10.1 EVR shall be entitled to cancel this agreement if any payments are overdue, and the Hirer has been given not less than 2 working days’ written notice of the proposed cancellation.
10.2 On any cancellation of this agreement by the Hirer, the Hirer is liable to pay to EVR the following amounts within 10 working days:
Event Cancellation. NCSI, the federal government, the sponsoring/hosting organization, and/or co-sponsoring organization(s), in their sole individual discretion, reserve the right to cancel or postpone this event at any time without any liability for the fulfillment of this contract and all fees paid by Vendor shall, in the sole discretion of NCSI, be either credited to future events or refunded on a prorated basis (less NCSI’s direct costs and reasonable overhead expenses). If the event or any part thereof is canceled or postponed for any reason beyond the control of NCSI such as, but not limited to, damage or destruction to the venue buildings, war, riots, strikes, fire, floods, weather, termination by sponsoring/hosting organization or co-sponsoring organizations(s), acts of government, terrorism, or acts of God, or the breach or termination of the venue contract, then NCSI is not obligated to refund any fees. In any such case, credits from event postponement or cancellation must be used within 12 months of the original postponement/cancellation dates. After 12 months a credit on account will be considered earned by NCSI and non-refundable.
Event Cancellation. The City agrees to pay 70% of the expected event amount for any cancellation unless sufficient prior notice is provided. “Prior Notice” is defined as at least 10 business days (including the day of the event) before the scheduled event.
Event Cancellation. Adventure Enablers is not responsible for event cancellations due to acts of God. Charges will be based on the race minimum or the number of registered participants, whichever is greater.
