Evergreen Status. In the case of an HCP Customer, Customer shall use commercially reasonable efforts to obtain “evergreen” designation for this Agreement, commencing on the Billing Commencement Date and continuing thereafter for the duration of the Initial Term and any Renewal Term(s).
