Common use of Evidence of Forfeiture Clause in Contracts

Evidence of Forfeiture. A statement signed by an authorised officer of the Trustee that: (a) a Partly Paid Unit has been forfeited on a stated date; and (b) no forfeiture of Units has been cancelled in accordance with clause 9.9, is conclusive evidence of that fact as against all persons claiming to be entitled to the forfeited Units.
