Common use of Evidence of Rights of Noteholders Clause in Contracts

Evidence of Rights of Noteholders. (1) Any request, direction, notice, consent or other instrument which this Indenture may require or permit to be signed or executed by the Noteholders may be in any number of concurrent instruments of similar tenor signed or executed by such Noteholders. (2) The Trustee may, in its discretion, require proof of execution in cases where it deems proof desirable and may accept such proof as it shall consider proper.

The Trustee Corporation may, nevertheless, in its discretion, require further proof of execution in cases where when it deems further proof desirable and or may accept such other proof as it shall consider proper. The ownership of Notes shall be proved by the Register as herein provided.

The ownership of Subordinate Secured Notes shall be proved by the Register as herein provided.
