Common use of Examinations to Determine Abuse or Neglect Clause in Contracts

Examinations to Determine Abuse or Neglect. Upon notification by the County Children and Youth Agency system, Provider must provide Covered Persons under evaluation as possible victims of child abuse or neglect and who present for physical examinations for determination of abuse or neglect, with such services. These services must be performed by trained examiners in a timely manner according to the Child Protective Services Law, 23 Pa. C.S. §§6301 et seq. and Department regulations. Provider must ensure that emergency department staff and physicians know the procedures for reporting suspected abuse and neglect in addition to performing exams for Covered Services under the care of the county Children and Youth Agency. This includes abuse or neglect of member over the age of 21 and reporting to Adult Protective Services.
