Except for the open source programs included in the Products, immixTechnology acknowledges that the Products, including the structure, organization and design of hardware, firmware and software included as part of the Products constitute proprietary and valuable trade secrets (and other moral rights and intellectual property rights) of Vendor or its licensors. immixTechnology will not attempt, and will use best efforts to prevent Government Customers, employees and contractors from attempting to: (i) modify, translate, reverse engineer (except to the limited extent permitted by law), decompile, disassemble, create, derivative works based on, sublicense, or distribute the software, hardware or firmware or the accompanying documentation; (ii) rent or lease any rights in the software, hardware or firmware or accompanying documentation in any form to any person; or (iii) remove any proprietary notice, labels, or marks on the software or firmware, documentation, and containers. immixTechnology acknowledges and agrees that Vendor provides sufficient information including access on its website to source code for the original open source programs included in the Products.
