Common use of Exception to Arbitration Clause in Contracts

Exception to Arbitration. Notwithstanding the above, if Executive violates Section 11 hereof, the Bank will have the right to initiate the court proceedings described in Section 12.2, in lieu of an arbitration proceeding under this Section 14. The Bank may initiate these proceedings wherever appropriate within the state of Washington, but Executive will consent to venue and jurisdiction in King County, Washington.

Exception to Arbitration. Notwithstanding the above, if Executive Employee violates Section 11 hereofor 12, the Bank will have the right to initiate the court proceedings described in Section 12.213(b), in lieu of an arbitration proceeding under this Section 1415. The Bank may initiate these proceedings wherever appropriate within the state of Washington, Washington State; but Executive Employee will consent to venue and jurisdiction in King County, Washington.
