Exception to Binding Arbitration. Notwithstanding any other provision to the contrary in this Article 12.6 or elsewhere in this Agreement the Contractor shall have no cause of action for damages against City in relation to any dispute or claim it may have relating to Rates, Special Charges or a fair and reasonable rate of return. Any adjustment in Rates shall be recovered through the rate base.
Exception to Binding Arbitration. Bank agrees not to invoke its right to arbitrate any individual claim you bring in small claims court or an equivalent court of limited jurisdiction (if such claim involves less than $15,000 amount in controversy) so long as the claim is pending only in that court. This arbitration provision also does not limit or constrain the Bank’s right to interplead funds in the event of claims to account funds by different parties.
