Common use of Exception to Obligation Clause in Contracts

Exception to Obligation. Notwithstanding the foregoing, there will be no obligation on BellSouth or Cbeyond to protect any portion of the Information that is: (1) made publicly available by the owner of the Information or lawfully disclosed by a Party other than BellSouth or Cbeyond; (2) lawfully obtained from any source other than the owner of the Information; or (3) previously known to the receiving Party without an obligation to keep it confidential.

Exception to Obligation. Notwithstanding the foregoing, there will be no obligation on BellSouth or Cbeyond Pinnacle to protect any portion of the Information that is: (1) made publicly available by the owner of the Information or lawfully disclosed by a Party other than BellSouth or CbeyondPinnacle; (2) lawfully obtained from any source other than the owner of the Information; or (3) previously known to the receiving Party without an obligation to keep it confidential.

Exception to Obligation. Notwithstanding the foregoing, there will be no obligation on BellSouth or Cbeyond Satcom to protect any portion of the Information that is: (1) made publicly available by the owner of the Information or lawfully disclosed by a Party other than BellSouth or CbeyondSatcom; (2) lawfully obtained from any source other than the owner of the Information; or (3) previously known to the receiving Party without an obligation to keep it confidential.

Exception to Obligation. Notwithstanding the foregoing, there will be no obligation on BellSouth or Cbeyond Max-Tel to protect any portion of the Information that is: (1) made publicly available by the owner of the Information or lawfully disclosed by a Party other than BellSouth or CbeyondMax-Tel; (2) lawfully obtained from any source other than the owner of the Information; or (3) previously known to the receiving Party without an obligation to keep it confidential.

Exception to Obligation. Notwithstanding the foregoing, there will be no obligation on BellSouth or Cbeyond NewSouth to protect any portion of the Information that is: (1) made publicly available by the owner of the Information or lawfully disclosed by a Party other than BellSouth or CbeyondNewSouth; (2) lawfully obtained from any source other than the owner of the Information; or (3) previously known to the receiving Party without an obligation to keep it confidential.

Notwithstanding the foregoing, there will be no obligation on BellSouth or Cbeyond ALLIANCE to protect any portion of the Information that is: (1) made publicly available by the owner of the Information or lawfully disclosed by a Party other than BellSouth or CbeyondALLIANCE; (2) lawfully obtained from any source other than the owner of the Information; or (3) previously known to the receiving Party without an obligation to keep it confidential.confidential.‌
