Common use of Exception to Obligation Clause in Contracts

Exception to Obligation. Notwithstanding the foregoing, there will be no obligation on BellSouth or Al-Call to protect any portion of the Information that is: (1) made publicly available by the owner of the Information or lawfully disclosed by a Party other than BellSouth or Al-Call; (2) lawfully obtained from any source other than the owner of the Information; or (3) previously known to the receiving Party without an obligation to keep it confidential.
