Common use of Exception to Obligation Clause in Contracts

Exception to Obligation. Notwithstanding the foregoing, there will be no obligation on BellSouth or NewSouth to protect any portion of the Information that is: (1) made publicly available by the owner of the Information or lawfully disclosed by a Party other than BellSouth or NewSouth; (2) lawfully obtained from any source other than the owner of the Information; or (3) previously known to the receiving Party without an obligation to keep it confidential.

Exception to Obligation. Notwithstanding the foregoing, there will be no obligation on BellSouth or NewSouth Access One to protect any portion of the Information that is: (1) made publicly available by the owner of the Information or lawfully disclosed by a Party other than BellSouth or NewSouthAccess One; (2) lawfully obtained from any source other than the owner of the Information; or (3) previously known to the receiving Party without an obligation to keep it confidential.

Notwithstanding the foregoing, there will be no obligation on BellSouth or NewSouth Max-Tel to protect any portion of the Information that is: (1) made publicly available by the owner of the Information or lawfully disclosed by a Party other than BellSouth or NewSouthMax-Tel; (2) lawfully obtained from any source other than the owner of the Information; or (3) previously known to the receiving Party without an obligation to keep it confidential.

Exception to Obligation. Notwithstanding the foregoing, there will be no obligation on BellSouth or NewSouth BroadRiver to protect any portion of the Information that is: (1) made publicly available by the owner of the Information or lawfully disclosed by a Party other than BellSouth or NewSouthBroadRiver; (2) lawfully obtained from any source other than the owner of the Information; or (3) previously known to the receiving Party without an obligation to keep it confidential.
