EXCEPTIONS TO PREVENT UNDUE HARDSHIP. In the event that the application of Section 6(a)(i) and/or Section 6(a)(ii) would, in the Company's judgment, cause undue hardship to the Employee, the Management Company shall, upon written request by the Employee, provide to the Employee a written instrument authorizing such specific exceptions to the provisions of Section 6(a)(i) and/or Section 6(a)(ii) as the President of Juno Online Services, Inc. shall determine are reasonably necessary to prevent such undue hardship, the provisions of which instrument shall thereafter be deemed to supersede the corresponding provisions of Section 6(a)(i) and/or Section 6(a)(ii).
