Excess Usage Fees. At the end of each month during the term of this Agreement, Lender will determine the number of days ("Excess Usage Days") during the month on which the Warehousing Advances outstanding during such month ("Daily Outstanding Balances") exceeded $125,000,000 ("Usage Target"). For each Excess Usage Day in the month, Borrower must pay to Lender a fee ("Excess Usage Fee") in the amount of 0.125% per annum on the amount by which the Daily Outstanding Balance exceeded the Usage Target. The Excess Usage Fee is payable monthly, in arrears. Lender computes the Excess Usage Fee on the basis of the actual number of days in each month and a year of 360 days. Borrower must pay the Excess Usage Fee within 9 days after the date of Lender's invoice or, if applicable, within 2 days after the date of Lender's account analysis statement Lender's determination of the Excess Usage Fee for any period is conclusive and binding, absent manifest error.

Excess Usage Fees. If you exceed any usage limits set in your Subscription Terms, we will bill you for the excess usage as described in the Subscription Terms. To the extent your Subscription Terms do not specify excess usage terms, the following provisions will apply: (i) your per unit price will be the standard list price available on the Services; (ii) your limit will be one hundred (100) units (for example documents or transactions) per licensed user per month of Services; (iii) Provider will bill you for excess usage monthly or in other reasonable increments; and (iv) you are responsible for tracking your usage, and Provider is not obligated to notify you before you incur excess usage fees.

Excess Usage Fees. The VIDIZMO Service includes the ability for the customer and its users to access the VIDIZMO Service and consume content thereby consuming Bandwidth. If the Bandwidth consumed by the Customer’s account exceeds the limits set forth by the Subscription Plan purchased by the Customer, the Customer will be charged an excess usage fee at then overages rates based on the difference of Internet usage (viewing hours) consumed by Customer and the Internet usage (viewing hours) allowed in the purchased Subscription Plan. VIDIZMO provides reports on Internet usage to help Customer track Internet usage (viewing hours) being consumed by Customer and hence to keep it under control and allowed limits. VIDIZMO reserves the right to establish or modify its general practices and limits relating to excess usage fees, provided no decrease in Bandwidth consumption limits are allowed during the Subscription Plan’s then current term.

  • Excess Usage If during a Billing Period, In Energy is greater than zero (0), then Excess Usage for that Billing Period will be calculated. If Excess Usage is greater than zero (0), then for the Facility and any secondary account at the conclusion of that Billing Period: (i) kilowatt-hour usage will equal the value of Excess Usage and (ii) Unused Credits are equal to zero (0). If Excess Usage is equal to zero (0), then for the Facility and secondary accounts at the conclusion of that Billing Period: (i) kilowatt-hour usage is equal to zero (0) and (ii) Unused Credits are reduced by the value of In Energy, determined for that Billing Period, and that reduced value, in accordance with paragraph (C) Unused Credits of this Article IV, will remain for possible future application.
