Exclusions from Maintenance. Unless otherwise agreed, Nuance shall not be obligated to provide Maintenance for, or required as result of (i) any modification of Development Software by anyone other than Nuance; (ii) if Development Software is used for other than its intended purpose; (iii) if Licensee failed to properly install or maintain the Development Software (including any associated equipment, software or firmware); (iv) any willful or negligent action or omission of Licensee, (v) any computer malfunction not attributable to the Development Software; or (vi) damage to Development Software from any external source, including computer viruses unattributable to Nuance, computer hackers, or force majeure events.
Exclusions from Maintenance. 7.4 Исключения из услуг по Технической поддержке. 7.4.1 Customer is not entitled to receive any Maintenance for Software that Customer has modified. Any modifications Customer make to the Software including to any Embedded or External Software will render the Maintenance void. Company will not be liable to Customer for any errors, losses or damage resulting from modifications that Customer make to the Software. Company is only responsible for maintaining the unaltered release of the Software licensed to Customer under this Agreement. Exclusions from Maintenance. The following is excluded from the maintenance service: Maintenance of grounds and walks. General household maintenance (replacing light bulbs, cleaning carpets pest control) Damage caused by Tenant abuse or, in some cases Vandalism (see section 5).
Exclusions from Maintenance. J&J Vision shall have no obligation to provide maintenance services or replacement parts for the Equipment in connection with: (a) Repair, replacement, or maintenance arising from (i) any acts of negligence of Customer’s employees, agents, or invitees or any third party not under the control of J&J Vision, (ii) attempts to repair, modify, or service the Equipment made by persons who are not J&J Vision certified to perform such service, (iii) use of special attachments, devices or disposables not provided by J&J Vision in connection with the Equipment, (iv) tampering in any way with any Treatment Card, Patient Interface, or any procedure counting mechanism in the Equipment, or (v) misuse of the Equipment including, without limitation, use of the Equipment for any application or function for which it was not designed; (b) Repairs or maintenance of accessories, attachments, supplies, machines, or other devices not furnished by J&J Vision, or of electrical work external to the Equipment; (c) Repairs or maintenance required by damage to the Equipment resulting from transportation by Customer, or causes (other than ordinary use) within the reasonable control of Customer, such as inadequate electrical power or environmental temperature control; (d) Repair, replacement, or maintenance arising from damage to or destruction of the Equipment as a result of or caused by fire or explosion of any origin, riot, civil commotion, aircraft, war, or any Act of God including but not limited to lightning, windstorm, hail, flood, or earthquake; (e) An unauthorized move of the equipment by persons who are not J&J Vision certified to perform such service; (
Exclusions from Maintenance. Pitney ▇▇▇▇▇ shall have no obligation to provide Software Maintenance if such Software Maintenance is required due to: (i) any event that would cause the warranty in this Agreement to be inapplicable or void (whether during or after the Warranty Period); or (ii) failure by Licensee to implement the most current update or software patch available from Pitney ▇▇▇▇▇. Software Maintenance excludes any Pitney ▇▇▇▇▇ responsibility with respect to Licensee’s operating systems, third-party connectivity software to host computers or web browsers. Pitney Bowes shall not be responsible for interruptions in the Pitney ▇▇▇▇▇ Software that are the result of machine failure or software supplied by vendors other than Pitney ▇▇▇▇▇, improper preparation of input data, modification(s) performed by Licensee or its agent, or attempts to use the Pitney ▇▇▇▇▇ Software in a manner for which it was not intended. If Pitney ▇▇▇▇▇ elects to provide Software Maintenance notwithstanding the occurrence of an event specified in this paragraph, Pitney ▇▇▇▇▇ may charge Licensee, and Licensee shall pay, Pitney Bowes’s standard fees, as then in effect, for the services and materials provided.

If Customer requires the services of D.C.I. in connection with the relocation of the equipment, Customer will pay D.C.I. for such services at D.C.I.’s then current standard and reasonable rate. This Agreement does not cover damages due to or failure of the equipment caused by actions other than wear and tear resulting from normal use, including but not limited to misuse, negligence, accident, theft or unexpected loss, abuse, connection to direct current, fire, flood, wind, lightning, acts of terrorism or other acts of God. Some of these costs can often be recouped by claiming loss on Customer insurance policies. Also not covered are improper wiring, installation, repair or alteration by anyone other than D.C.I. Repairs necessitated by any of the above excepted causes shall be made by D.C.I. at its standard charges for labor and materials.
