Exclusive Authority; Representative Sample Clauses

Exclusive Authority; Representative. Without limiting the authority of the Litigation Trust or the Litigation Trustee set forth in this Litigation Trust Agreement herein, the Plan or the Confirmation Order, the Litigation Trust shall be deemed to be a party in interest, and shall have the exclusive right, power, and interest to pursue, settle, defend, or abandon, as the case may be, all Litigation Trust Causes of Action, as the representative of the EPC Reorganizing Debtors’ and their Estates pursuant to Section 1123(b)(3) of the Bankruptcy Code.
