Common use of Exclusive Representations and Warranties Clause in Contracts

Exclusive Representations and Warranties. Other than the representations and warranties set forth in this Article 7, neither MUTUAL nor SUN is making, or has made, any other representations or warranties, express or implied, either written or oral, with respect to the Products and the Purchased Assets or any other matter, including: (i) any warranty as to the accuracy or completeness of any information regarding the Purchased Assets; (ii) of merchantability of fitness for a particular purpose; (iii) infringement or misappropriation of third party rights; or (iv) any information, documents or material made available to TRIBUTE, management presentations or any other documents (including those relating to future revenue, profitability or success with the Purchased Assets), and all such warranties are disclaimed.
