EXECUTION AND EFFECTIVE DATE. This Agreement shall take effect upon the effective date of a license issued by the FERC consistent with this Agreement. If the FERC issues a new license inconsistent with this Agreement and if a Party appeals, the Agreement shall not go into effect. The Parties retain the right to appeal the issuance of a license in whole or in part if unacceptable provisions are added, including stay of any provision.
