Common use of Execution by the Company Clause in Contracts

Execution by the Company. The Company, by its execution in the space provided below, agrees that it will cause the certificates issued after the date hereof evidencing the shares of Common Stock and Preferred Stock to bear the legend required by Section 7 herein, and it shall supply, free of charge, a copy of this Agreement to any holder of a certificate evidencing shares of capital stock of the Company upon written request from such holder to the Company at its principal office. The Parties hereto do hereby agree that the failure to cause the certificates evidencing the shares of Common Stock and Preferred Stock to bear the legend required by Section 7 herein and/or failure of the Company to supply, free of charge, a copy of this Agreement as provided under this Section 12 shall not affect the validity or enforcement of this Agreement.

Execution by the Company. The Company, by its execution in the space provided below, agrees that it will cause the certificates issued after the date hereof evidencing the shares of Common Stock and Preferred Stock to bear the legend required by Section 7 herein4.10 of this Agreement, and it shall supply, free of charge, a copy of this Agreement to any holder of a certificate evidencing shares of capital stock of the Company upon written request from such holder to the Company at its principal office. The Parties hereto to this Agreement do hereby agree that the failure to cause the certificates evidencing the shares of Common Stock and Preferred Stock to bear the legend required by Section 7 4.10 herein and/or and the failure of the Company to supply, free of charge, a copy of this Agreement as provided under this Section 12 4.11 shall not affect the validity or enforcement of this Agreement.

The Parties hereto parties to this Agreement do hereby agree that the failure to cause the certificates evidencing the shares of Common Stock and Preferred Stock to bear the legend required by Section 7 herein and/or 3(b) and the failure of the Company to supply, free of charge, a copy of this Agreement as provided under this Section 12 3(c) shall not affect the validity or enforcement of this Agreement.

The Parties parties hereto do hereby agree that the failure to cause the certificates evidencing the shares of Common Stock and Preferred Stock to bear the legend required by Section 7 4 herein and/or failure of the Company to supply, free of charge, a copy of this Agreement as provided under this Section 12 9 shall not affect the validity or enforcement enforceability of this Agreement.

The Parties parties hereto do hereby agree that neither the failure to cause the certificates evidencing the shares of Common Stock and Preferred Stock capital stock of the Company to bear the legend required by Section 7 herein and/or 6 hereof nor the failure of the Company to supply, free of charge, a copy of this Agreement Agreement, as provided under this Section 12 11, shall not affect the validity or enforcement of this Agreement.

The Parties parties hereto do hereby agree that the failure to cause the certificates evidencing the shares of Common Stock and Preferred Stock to bear the legend required by Section 7 4.4 herein and/or the failure of the Company to supply, free of charge, a copy of this Agreement as provided under this Section 12 4.5 shall not affect the validity or enforcement enforceability of this Agreement.

The Company, by its execution in the space provided below, agrees that it will cause the certificates issued after the date hereof evidencing the shares of Common Stock and Preferred Stock capital stock subject to this Agreement to bear the legend required by Section 7 paragraph 11 herein, and it shall supply, free of charge, a copy of this Agreement to any holder of a certificate evidencing shares of capital stock of the Company upon written request from such holder to the Company at its principal office. The Parties parties hereto do hereby agree that the failure to cause the certificates evidencing the shares of Common Stock and Preferred Stock capital stock subject to this Agreement to bear the legend required by Section 7 paragraph 11 herein and/or failure of the Company to supply, free of charge, a copy of this Agreement as provided under this Section paragraph 12 shall not affect effect the validity or enforcement of this Agreement.

The Company, by its execution in the space provided below, agrees that it will cause the certificates issued after the date hereof evidencing the shares of Common Stock and Preferred Stock capital stock of the Company to bear the legend required by Section 7 herein5.10 of this Agreement, and it shall supply, free of charge, a copy of this Agreement to any holder of a certificate evidencing shares of capital stock of the Company upon written request from such holder to the Company at its principal office. The Parties hereto to this Agreement do hereby agree that the failure to cause the certificates evidencing the shares of Common Stock and Preferred Stock capital stock of the Company to bear the legend required by Section 7 5.10 herein and/or and the failure of the Company to supply, free of charge, a copy of this Agreement as provided under this Section 12 5.11 shall not affect the validity or enforcement of this Agreement.

Execution by the Company. The Company, by its execution in the ------------------------ space provided below, agrees that it will cause the certificates issued after the date hereof evidencing the shares of Common Stock and Preferred Stock capital stock subject to this Agreement to bear the legend required by Section 7 14 herein, and it shall supply, free of charge, a copy of this Agreement to any holder of a certificate evidencing shares of capital stock of the Company upon written request from such holder to the Company at its principal office. The Parties parties hereto do hereby agree that the failure to cause the certificates evidencing the shares of Common Stock and Preferred Stock capital stock subject to this Agreement to bear the legend required by Section 7 14 herein and/or failure of the Company to supply, free of charge, a copy of this Agreement as provided under this Section 12 14 shall not affect effect the validity or enforcement of this Agreement.
