Common use of Execution by the Company Clause in Contracts

Execution by the Company. The Company, by its execution in the space provided below, agrees that it will cause the certificates issued after the date hereof evidencing the shares of Investor Shares and Other Shares to bear the legend required by Section 6 hereof, and it shall supply, free of charge, a copy of this Agreement to any holder of a certificate evidencing shares of capital stock of the Company upon written request from such holder to the Company at its principal office, free of charge. The parties hereto do hereby agree that the failure to cause the certificates evidencing the shares of Investor Shares and Other Shares to bear the legend required by Section 6 hereof and/or failure of the Company to supply, free of charge, a copy of this Agreement, as provided under this Section 11, shall not affect the validity or enforcement of this Agreement.

Execution by the Company. The Company, by its execution in the space provided below, agrees that it will cause the certificates issued after the date hereof evidencing the shares of Investor Shares Common Stock and Other Shares Preferred Stock to bear the legend required by Section 6 hereof7 herein, and it shall supply, free of charge, a copy of this Agreement to any holder of a certificate evidencing shares of capital stock of the Company upon written request from such holder to the Company at its principal office, free of charge. The parties Parties hereto do hereby agree that the failure to cause the certificates evidencing the shares of Investor Shares Common Stock and Other Shares Preferred Stock to bear the legend required by Section 6 hereof 7 herein and/or failure of the Company to supply, free of charge, a copy of this Agreement, Agreement as provided under this Section 11, 12 shall not affect the validity or enforcement of this Agreement.

Execution by the Company. The Company, by its execution in the space provided below, agrees that it will cause the physical certificates issued after the date hereof hereof, and any book entries made by the Company’s transfer agent after the date hereof, in either case evidencing the shares of Investor Shares and Other Shares to bear the legend required by Section 6 hereof, and it shall supply, free of charge, a copy of this Agreement to any holder of a certificate evidencing shares of capital stock of the Company upon written request from such holder to the Company at its principal office, free of charge. The parties hereto do hereby agree that the failure to cause the certificates or any book entry evidencing the shares of Investor Shares and Other Shares to bear the legend required by Section 6 hereof and/or the failure of the Company to supply, free of charge, a copy of this Agreement, as provided under this Section 117(p), shall not affect the validity or enforcement of this Agreement.

Execution by the Company. The Company, by its execution in the space provided below, agrees that it will cause the certificates certificates, if any, issued after the date hereof evidencing the shares of Investor Shares Units and Other Shares Common Units to bear the legend required by Section 6 hereof, and it shall supply, free of charge, a copy of this Agreement to any holder of a certificate evidencing shares of capital stock equity securities of the Company upon written request from such holder to the Company at its principal office, free of charge. The parties hereto do hereby agree that the failure to cause the certificates certificates, if any, evidencing the shares of Investor Shares Units and Other Shares Common Units to bear the legend required by Section 6 hereof and/or failure of the Company to supply, free of charge, a copy of this Agreement, as provided under this Section 1112, shall not affect the validity or enforcement of this Agreement.

The parties hereto do hereby agree that the failure to cause the certificates evidencing the shares of Investor Shares and Other Founder Shares to bear the legend required by Section 6 hereof and/or failure of the Company to supply, free of charge, a copy of this Agreement, as provided under this Section 11, shall not affect the validity or enforcement of this Agreement.

The parties hereto do hereby agree that the failure to cause the certificates evidencing the shares of Investor Shares Stock and Other Shares Common Holder Stock to bear the legend required by Section 6 hereof and/or failure of the Company to supply, free of charge, a copy of this Agreement, as provided under this Section 116, shall not affect the validity or enforcement of this Agreement.

The parties Parties hereto do hereby agree that the failure to cause the certificates evidencing the shares of Investor Shares and Other Common Holder Shares to bear the legend required by Section 6 hereof herein and/or failure of the Company to supply, free of charge, a copy of this Agreement, Agreement as provided under this Section 11, 12 shall not affect the validity or enforcement of this Agreement.

The parties hereto do hereby agree that the failure to cause the certificates evidencing the shares of Investor Shares Stock and Other Shares Common Holder Stock to bear the legend required by Section 6 5 hereof and/or failure of the Company to supply, free of charge, a copy of this Agreement, as provided under this Section 115, shall not affect the validity or enforcement of this Agreement.

The parties hereto do hereby agree that the failure to cause the certificates evidencing the shares of Investor Shares and Other Common Holder Shares to bear the legend required by Section 6 5 hereof and/or failure of the Company to supply, free of charge, a copy of this Agreement, Agreement as provided under this Section 11, 11 shall not affect the validity or enforcement of this Agreement.
