EXECUTION OF WORKS. 40.1 The work execution will be carried out based on the documents as listed below.
a. Conditions of Contract Part I: General Conditions of Contract
EXECUTION OF WORKS. To the extent that the Contract involves any execution of works, whether in whole or in part, and unless specifically stated in the Contract, the following terms and conditions shall apply to any execution of works: Obligation to Perform in Accordance with the Contract The Contractor shall execute and complete the works and remedy any defects therein in strict accordance with the Contract, with due care and diligence and to the satisfaction of SPC, and shall provide all labour, including the supervision thereof, materials, constructional plant and all other things, whether of a temporary or permanent nature, required in and for such execution, completion and remedying of defects, as far as the necessity for providing the same is specified in or is reasonably to be inferred from the Contract. The Contractor shall comply with and adhere strictly to SPC’s instructions and directions on any matter, touching or concerning the works. The Contractor shall execute and complete the works in accordance with article 26 of these general terms and conditions, in particular with regard to health and safety requirements, insurance, working conditions for workers, construction, administration and environmental law. Insurance of the works The Contractor shall insure at its own costs, immediately following signature of the Contract, in the joint names of SPC and the Contractor for the entire duration of the Contract, including the defect liability period, against all loss or damage from whatever cause arising, other than cause of Force majeure and against loss or damage for which the Contractor is responsible. The Contractor shall insure against his liability for any death, material or physical damage, loss or injury which may occur to any property (including that of SPC) or to any person (including any employee of SPC) by or arising out of the execution of the works or in the carrying out of the Contract. The Contractor shall insure against the liability of any accident or injury any xxxxxxx or other person in the employment of the Contractor or any subcontractor. Responsibility of the Contractor The Contractor shall take full responsibility for the adequacy, stability, and safety of all site operations and methods of construction. EXECUTION OF WORKS. The Works are to be executed with minimal disruption and inconvenience to ongoing activities and facilities in the building and the Contractor’s working programme and/or method statement is to be agreed with the Representative prior to commencement of the Works.
EXECUTION OF WORKS. 9.1 To the extent that the Contract involves any execution of works, whether in whole or in part, and unless specifically stated in the Contract, the following terms and conditions shall apply to any execution of works:
EXECUTION OF WORKS. The Landlord will procure that the Date of Practical Completion occurs by the Target Date except for the Post Completion Works.
EXECUTION OF WORKS. The Landlord will use reasonable endeavours to procure that the Date of Practical Completion occurs by the Target Date.
EXECUTION OF WORKS. To execute the Works in strict compliance with (i) the provisions of the Contract Documents; (ii) MWC's directives; (iii) all Laws and Regulations, Standards and Codes; (iv) instructions of Relevant Authorities; and (v) the Proposal. To comply with the standards indicated in Volume 3 (SOW) for the specific purposes and works indicated therein (including "General Technical Requirements" chapter). In the event Volume 3 (SOW) does not indicate a specific standard for a specific purpose or work the Supplier shall comply with all official Israeli Standards (IS) and/or American and/or European standards MWC shall confirm as applicable for the specific purpose and work. MWC may require the Supplier – in addition to an applicable standard (as provided above) or specifically - to execute any element of the Project in accordance with MWC's Chief Engineer's Instructions (denoted in Hebrew as: "›vnt o‹z«c ntntt«")] which MWC shall confirm as applicable for specific purpose and work. MWC's Chief Engineer's Instructions (valid to the date of the Tender's publication) which will be provided to the Supplier and in any event a review thereof is required during Tender stage and until Signature Date – that may be coordinated ahead.
EXECUTION OF WORKS. 12.1 The Contractor shall execute, complete, and maintain works under the Contract and he shall comply with the Engineer's written instructions and orders regarding any subject related to the works, whether or not the same is mentioned in the Contract. The Contractor shall receive instructions from the Engineer or the Engineer's representative within the scope referred to in Article 2 of these Conditions.
12.2 The Contractor shall comply with the following:
A. The Contractor shall purchase national products and he may not use similar products imported from abroad for the purpose of executing the Contract
B. The material used, whether local or imported, to execute the Contract shall comply with the standard specifications approved by the Saudi Standards, Metrology, and Quality Organization. Regarding material for which Saudi standard specifications have not been issued, such material shall conform to a set of internationally recognized standards specified by the supervisor of execution.
C. The Contractor shall comply with the laws, standards, and regulations for environmental protection in the Kingdom, as issued by competent authorities.
D. Foreign contractors shall assign to a Saudi contractor not less than 30% of Contracted work. The competent authority shall, in agreement with the Ministry of Finance and National Economy, exempt the foreign contractor from full or partial compliance to giving a Saudi contractor said percentage if it is proven that there is no work that can be performed by a Saudi contractor or if the works available are less than 30%. In order to apply this exemption, the competent authority, upon preparing the project and before requesting tenders, shall determine the ratio of partial or total exemption by its technical staff in collaboration with the consultant who designed the project and its specifications.
E. The Contractor shall undertake to purchase the tools and equipment he needs for the execution of this Contract from Saudi dealers providing such equipment and machinery in the Kingdom. He may not import directly from abroad except when importing his personal equipment.
F. The Contractor shall be obliged to obtain the following services from local Saudi establishments:
1. Transport services of goods and individuals within the Kingdom if the Contractor has not performed the same directly using equipment owned by the same or by persons who work directly with the Contractor
2. Local insurance services
3. Banking services

EXECUTION OF WORKS. 3.1 In consideration of the payments to be made by the Employer to the Contractor as hereinafter mentioned, the Contractor hereby covenants with the Employer to execute, design, supply, and complete the Works and remedy any defects therein in conformity with the provisions of the Contract.
EXECUTION OF WORKS. 4.1.1 All the Works shall be executed in strict conformity with the provisions of the Contract Documents, Applicable Laws and with such explanatory detailed Drawings, Specifications, and instructions as may be furnished from time to time to the Contractor by the Engineer-in-Charge whether mentioned in the Contract or not. The Contractor shall be responsible for ensuring that Works throughout are executed in the most substantial, proper and xxxxxxx like manner with the quality of material and workmanship in strict accordance with the Specifications and to the entire satisfaction of the Engineer-in-Charge.
4.1.2 Wherever it is mentioned in the Specifications that the Contractor shall perform certain Work or provide certain facilities/ materials, it is understood that the Contractor shall do, so at its cost, risk and expense.
4.1.3 The materials, design and workmanship shall satisfy the relevant Indian Standards, the job specification contained herein and codes referred to. Where the job specification stipulate requirements in addition to those contained in the standard codes and specifications, such additional requirements shall also be satisfied.
