Exemption for Certain Generators. A Generator with an Existing QF Contract with a UDC is not required to sign a Net Scheduled Participating Generator Agreement if: (a) the Generator sells all of its Energy (excluding any Energy consumed by auxiliary Load equipment electrically connected to the QF at the same point) and Ancillary Services to the UDC; (b) the Generator sells any Energy through ”over the fence” arrangements as authorized under Section 218(b) of the California Public Utilities Code; or (c) the Generator employs landfill gas technology for the generation of electricity as authorized under 218(c) of the California Public Utilities Code.
