Exemption to Prepayment Fee Clause Samples

The Exemption to Prepayment Fee clause defines circumstances under which a borrower can repay a loan early without incurring the usual prepayment penalty. Typically, this clause outlines specific events or conditions—such as refinancing with the same lender, making payments from insurance proceeds, or repaying due to a sale of collateral—where the fee is waived. Its core function is to provide flexibility for borrowers in certain situations, ensuring they are not unfairly penalized for early repayment under predefined, justified scenarios.
