Common use of Exercise of SARs Clause in Contracts

Exercise of SARs. (a) To the extent exercisable as provided in Section 3 of this Agreement, the SARs may be exercised in whole or in part by delivery to the Company of a notice in form and substance satisfactory to the Company specifying the number of SARs to be exercised and the date of exercise.

The Participant may, subject to the extent exercisable as provided in Section 3 limitations of this AgreementAgreement and the Plan, exercise all or any portion of the SARs may be exercised in whole or in part that have become vested and that have not been cancelled under Paragraphs 2 and 3 by delivery (i) providing notice of exercise to the Company of (in a notice in form and substance satisfactory acceptable to the Company Company) specifying the whole number of SARs to be exercised and the date of exercisebeing exercised.
