Existing Ancillary Facilities Sample Clauses
The 'Existing Ancillary Facilities' clause defines and addresses the status and treatment of any supporting facilities or infrastructure that are already in place at the time an agreement is made. This may include utilities, access roads, storage areas, or other structures that support the main project or property. The clause typically clarifies whether these facilities will be included in the transaction, who is responsible for their maintenance, and how their use will be managed going forward. Its core function is to ensure both parties have a clear understanding of what ancillary facilities exist and how they are to be handled, thereby preventing disputes or misunderstandings about their ownership and use.
Existing Ancillary Facilities. Notwithstanding any other provision of this Clause 7 (Ancillary Facilities) and without any requirement for compliance with any such other provision or for any further action by any party, immediately upon the occurrence of the Closing Date, each Existing Ancillary Facility shall be deemed to be an Ancillary Facility under this Agreement (and each borrower of an Existing Ancillary Facility that is so deemed shall be deemed a borrower of such Ancillary Facility).
Existing Ancillary Facilities. NatWest agrees to continue to provide the Existing Ancillary Facilities on the same terms and conditions which apply thereto on the date hereof save that the same may only be withdrawn or cancelled or required to be repaid in accordance with the provisions of Clause 13.2.
