Existing Project Assets. 2.4.1. In consideration of the Developer agreeing to perform and discharge its obligations as set forth in this Agreement, the SJDA hereby grants to the Developer, the exclusive right to enter upon, occupy and use the Project Site and Existing Project Assets for the purpose of implementing the Project and provision of Project Facilities and Services pursuant thereto in accordance with this Agreement. 2.4.2. The Developer shall at its costs, charges and expenses make such development and improvements in the Project Site and Existing Project Assets as may be necessary or appropriate for implementing the Project and providing Project Facilities and Services, in accordance with the Agreement, Applicable Laws and Applicable Permits.
