Existing Work. Buyer acknowledges that all or part of the Services or Items provided by Supplier under this Agreement may incorporate pre-existing and independently developed materials and information generally used or useable by Supplier in connection with the provision of products and services by Supplier to other customers (“Preexisting Work"). Unless otherwise expressly stated in the applicable SOW, Supplier shall retain all ownership rights in all Preexisting Work. Supplier grants Buyer a limited, nonexclusive, non-transferable worldwide license (including the right to sublicense as reasonably necessary to carry out the purpose of the license) to the Preexisting Work to the extent incorporated into the Services or Items.
Existing Work. In addition to FAR 52.236-9, “Protection of Existing Vegetation, Structures, Equipment, Utilities, and Improvements”, the Contractor shall repair or replace portions of existing work that have been altered during construction operations, unless otherwise agreed to in writing by the Contractor and the Government. Such repair or replacement shall match existing or adjoining work, as approved by the Contracting Officer. At the completion of operations, existing work shall be in a condition equal to or better than that which existed before work started.
Existing Work. All rights in any computer code or other written materials a party develops or obtains independent of this Agreement (“Pre-existing Work”) will remain the sole property of the party providing it. Each party may use, reproduce, and modify the other party’s Pre-existing Work only as needed to perform obligations related to Professional Services.
Existing Work. Before beginning any demolition work, survey the building interior and examine the drawings and specifications to determine the extent of the work. Record, in the presence of the Owner, showing the condition of facilities below or adjacent to areas of alteration or removal. Include in the record the location and extent of damage and description of surface conditions that exist prior to before starting work.
1.4.2 Items to Remain in Place Take necessary precautions to avoid damage to existing items to remain in place, to be reused, or to remain the property of the Owner. Repair or replace damaged items as approved by the Owner. Coordinate the work of this section with all other work indicated. Construct and maintain shoring, bracing, and supports as required. Ensure that structural elements are not overloaded. Increase structural supports or add new supports as may be required as a result of any cutting, removal, or demolition work performed under this contract. Do not overload pavements to remain. Provide new supports and reinforcement for existing construction weakened by demolition or removal work. Repairs, reinforcement, or structural replacement require approval by the Owner prior to performing such work.
Existing Work. All rights in any computer code or non-code based written materials developed or otherwise obtained by or for Microsoft or its Affiliates; independent of this agreement (“Pre-existing Work”) shall remain the sole property of the entity providing the Pre-existing Work. During the performance of Services, Microsoft and Institution grant to each other (and Microsoft’s Contractors as necessary) a temporary, non-exclusive license to use, reproduce and modify any of its Pre-existing Work provided to the each other, solely as needed to perform its obligations in connection with the Services.
Existing Work. Contractor shall perform an assessment of the Existing Work in accordance with the scope and procedures set forth in Exhibit K. If at any time Contractor identifies any modifications, changes, replacements or additions thereto to the Existing Work, Contractor shall notify Owner.
Existing Work. All rights in Pre-existing Work will remain the sole property of the party providing it. Each party may use, reproduce and modify the other party’s Pre-existing Work only as needed to perform obligations related to Professional Services.
Existing Work. Existing work shall be cut, drilled, altered, removed or temporarily removed and replaced as necessary for performance of work under this contract. Work that is replaced shall match similar existing work. Structural members shall not be cut or altered, except where noted on drawings, without authorization of the Contracting Officer. Work remaining in place which is damaged or defaced during performance of work shall be restored to the condition existing at time of placement of delivery order.
Existing Work. The Contract Price includes all work necessary to satisfy the recommendations resulting from the short circuit and protection coordination study obtained by NPPH.
Existing Work. Where a Purchase Order and/or a Statement of Work is being (or has been) prepared for work which is to be performed (Existing Work) You will be paid fees for the work which you perform at the rate which has been agreed with INSYGHT and which is specified in the Statement of Work.
