Expansion and Effective Date. A. The Expansion Space is subject to all the terms and conditions of the Lease except as expressly modified herein, herein and except that Tenant shall not be entitled to receive, with respect to the Expansion Space, receive any allowances, abatements or other financial concessions granted with respect to the Original Premises, as set forth in Exhibit C Premises unless such concessions are expressly provided for herein with respect to the Lease, Section III of the First Amendment and Exhibit B to the First AmendmentExpansion Space.
B. 1.02. The Expansion Effective Date shall be delayed to the extent that Landlord fails to deliver possession of the Expansion Space for any reason, including but not limited to, holding over by prior occupants. Any such delay in the Expansion Effective Date shall not subject Landlord to any liability for any loss or damage resulting therefrom. If the Expansion Effective Date is delayed, the Termination Date under the Lease shall not be similarly extended.

Expansion and Effective Date. A. Effective as of the date that this Second Amendment is executed and delivered by both parties December 1, 2005 (the “Expansion Effective Date”), the Premises, as defined in the Lease, is increased from 11,225 approximately 43,450 rentable square feet on of the 2nd and 3rd floors Building to 14,925 rentable square feet on approximately 53,280 of the 2nd and 3rd floor Building by the addition of the Expansion Space, and from and after the Expansion Effective Date, the Original Premises and the Expansion Space, collectively, shall be deemed the Premises, as defined in the LeaseLease and as used herein. The term of the Lease Term for the Expansion Space shall commence on the Expansion Effective Date and end on December 31, 2009 the Extended Termination Date (as defined in the “Termination Date”First Amendment).
