Common use of Expansion and Effective Date Clause in Contracts

Expansion and Effective Date. Effective as of November 1st, 2006 (“Expansion Effective Date”), the Premises is increased from 53,762 rentable square feet on the third, fourth, seventh, twelfth, sixteenth, seventeenth and nineteenth floors to 57,194 rentable square feet on the third, fourth, seventh, eighth, twelfth, sixteenth, seventeenth and nineteenth floors by the addition of the Expansion Space. The lease term for the Expansion Space shall commence on the Expansion Effective Date and end on August 31st, 2009 (the “Termination Date”). The Expansion Space is subject to all the terms and conditions of the Lease except as expressly modified herein and except that Tenant shall not be entitled to receive any allowances, abatement or other financial concession granted with respect to the Premises unless such concessions are expressly provided for herein with respect to the Expansion Space.

Effective as of November March 1st, 2006 2007 (“9th Floor Expansion Effective Date”), the Premises is increased from 53,762 rentable square feet on the third, fourth, seventh, twelfth, sixteenth, seventeenth and nineteenth floors to 57,194 rentable square feet on the third, fourth, seventh, eighth, twelfth, sixteenth, seventeenth and nineteenth floors to 63,672 rentable square feet by the addition of the 9th Floor Expansion Space and effective May 1st, 2007 (“14th Floor Expansion Effective Date”) the Premises is increased from 63,872 rentable square feet to 67,347 rentable square feet by the addition of the 14th Floor Expansion Space. The lease term for the Expansion Space shall commence on the respective Expansion Effective Date and end on August 31st, 2009 (the “Termination Date”). The Expansion Space is subject to all the terms and conditions of the Lease except as expressly modified herein and except that Tenant shall not be entitled to receive any allowances, abatement or other financial concession granted with respect to the Premises unless such concessions are expressly provided for herein with respect to the Expansion Space.

Effective as of November 1stMarch 1, 2006 2004 (the “Expansion Effective Date”), the Premises Premises, as defined in the Lease, is increased from 53,762 902 rentable square feet on the third, fourth, seventh, twelfth, sixteenth, seventeenth and nineteenth floors 16th floor to 57,194 1,788 rentable square feet on the third, fourth, seventh, eighth, twelfth, sixteenth, seventeenth and nineteenth floors 16th floor by the addition of the Expansion Space, and from and after the Expansion Effective Date, the Original Premises and the Expansion Space, collectively, shall be deemed the Premises, as defined in the Lease. The lease term Term for the Expansion Space shall commence on the Expansion Effective Date and end on August 31st, 2009 (the “Termination Date”). The Expansion Space is subject to all the terms and conditions of the Lease except as expressly modified herein and except that Tenant shall not be entitled to receive any allowances, abatement abatements or other financial concession concessions granted with respect to the Original Premises unless such concessions are expressly provided for herein with respect to the Expansion Space.
