Common use of Expansion of the Existing Premises Clause in Contracts

Expansion of the Existing Premises. Effective one-hundred-twenty (120) days after Delivery Date (“Expansion Commencement Date”), Tenant shall lease from Landlord and Landlord shall lease to Tenant that certain space commonly known as Suite 1300 comprised of 28,799 rentable square feet located on the entire thirteenth (13th) floor and Suite 1400 comprised of 27,983 rentable square feet located on the entire fourteenth (14th) floor of the Building, as outlined on the floor plans attached hereto as Exhibit “A” (the “Expansion Space”); provided, however, that Landlord shall deliver possession of the Expansion Space to Tenant no later than thirty (30) days after the date this Second Amendment is fully executed (“Delivery Date”). In the event Landlord does not deliver possession of the Expansion Space to Tenant on or before the Delivery Date, then Tenant shall be entitled to receive an abatement of Base Rent and Tenant’s Share of Direct Expenses equal to two (2) days for every one (1) day beyond the Delivery Date (unless such delay is due to Tenant Delays and/or Force Majeure delays). Effective upon the Expansion Commencement Date, the Existing Premises shall be increased to include the Expansion Space. Landlord and Tenant hereby agree that such addition of the Expansion Space to the Existing Premises shall, effective as of the Expansion Commencement Date, expand the Premises to a total of 214,607 rentable square feet. Effective as of the Expansion Commencement Date, all references to the “Premises” shall mean and refer to the Existing Premises as expanded by the Expansion Space.

Expansion of the Existing Premises. That certain space commonly known as Suite 250 and comprised of 13,522 rentable square feet located on the second (2nd) floor of the Building, as outlined on the plan attached to Exhibit “A” and made a part hereof, may be referred to herein as the “Expansion Space.” Effective one-hundred-twenty as of the later of (120i) days after Delivery Date March 1, 2017 or (ii) the date of Substantial Completion of the Expansion Space pursuant to Exhibit “A” attached hereto (“Expansion Commencement Date”), Tenant shall lease from Landlord and Landlord shall lease to Tenant that certain space commonly known as Suite 1300 comprised of 28,799 rentable square feet located on the entire thirteenth (13th) floor and Suite 1400 comprised of 27,983 rentable square feet located on the entire fourteenth (14th) floor of the Building, as outlined on the floor plans attached hereto as Exhibit “A” (the “Expansion Space”); provided. Accordingly, however, that Landlord shall deliver possession of the Expansion Space to Tenant no later than thirty (30) days after the date this Second Amendment is fully executed (“Delivery Date”). In the event Landlord does not deliver possession of the Expansion Space to Tenant on or before the Delivery Date, then Tenant shall be entitled to receive an abatement of Base Rent and Tenant’s Share of Direct Expenses equal to two (2) days for every one (1) day beyond the Delivery Date (unless such delay is due to Tenant Delays and/or Force Majeure delays). Effective effective upon the Expansion Commencement Date, the Existing Premises shall be increased to include the Expansion Space. Landlord and Tenant hereby agree that such addition of the Expansion Space to the Existing Premises shall, effective as of the Expansion Commencement Date, expand increase the Premises number of rentable square feet leased by Tenant in the Building to a total of 214,607 24,581 rentable square feet. Effective as of the Expansion Commencement Date, all references to the “Premises” shall mean and refer to the Existing Premises as expanded by the Expansion Space.

Expansion of the Existing Premises. Effective one-hundred-twenty (120) days after Delivery Date (“Expansion Commencement Date”), Tenant shall lease from Landlord and Landlord shall lease to Tenant that That certain space located on the third (3rd) floor of the Building commonly known as Suite 1300 comprised of 28,799 rentable square feet located on the entire thirteenth (13th) floor and Suite 1400 comprised of 27,983 rentable square feet located on the entire fourteenth (14th) floor of the Building360, as outlined on the floor plans plan attached hereto as Exhibit “A” (and made a part hereof, may be referred to herein as the “Suite 360 Expansion Space”); provided, however, .” Landlord and Tenant hereby stipulate that Landlord shall deliver possession the Suite 360 Expansion Space contains 2,826 square feet of Net Rentable Area and 2,371 square feet of Usable Area. Subject to satisfaction of the Expansion Space to Tenant no later than thirty (30) days after the date this Second Amendment is fully executed Condition Precedent described in Section 11 below and effective as of August 1, 0000 (“Delivery Xxxxx 000 Expansion Commencement Date”). Landlord and Tenant hereby agree that such addition of the Suite 360 Expansion Space to the Existing Premises shall, effective as of the Suite 360 Expansion Commencement Date, expand increase the Premises number of rentable square feet leased by Tenant in the Building to a total of 214,607 rentable 113,327 square feetfeet of Net Rentable Area (000,000 xxxxxx xxxx xx Xxxxxx Xxxx). Effective as of the Suite 360 Expansion Commencement Date, all references to the “Premises” shall mean and refer to the Existing Premises as expanded by the Suite 360 Expansion Space.

Expansion of the Existing Premises. That certain space contiguous to the Existing Premises located on the second (2nd) floor of the Building and outlined on the floor plan attached hereto as Exhibit "A" and made a part hereof, may be referred to herein as the "EXPANSION SPACE." Landlord and Tenant hereby stipulate that the Expansion Space contains 2,251 square feet of Net Rentable Area (1,743 square feet of Usable Area). Effective one-hundred-twenty as of the earlier of (120i) days after Delivery Date the date of substantial completion of Landlord's Work (“as defined in Section 5.2 below); or (ii) the date Tenant commences business operations in all or any portion of the Expansion Commencement Date”Space ("EXPANSION COMMENCEMENT DATE"), Tenant shall shall, subject to Section 13 below, lease from Landlord and Landlord shall lease to Tenant that certain space commonly known as Suite 1300 comprised of 28,799 rentable square feet located on the entire thirteenth (13th) floor and Suite 1400 comprised of 27,983 rentable square feet located on the entire fourteenth (14th) floor of the Building, as outlined on the floor plans attached hereto as Exhibit “A” (the “Expansion Space”); provided. Accordingly, however, that Landlord shall deliver possession of the Expansion Space to Tenant no later than thirty (30) days after the date this Second Amendment is fully executed (“Delivery Date”). In the event Landlord does not deliver possession of the Expansion Space to Tenant on or before the Delivery Date, then Tenant shall be entitled to receive an abatement of Base Rent and Tenant’s Share of Direct Expenses equal to two (2) days for every one (1) day beyond the Delivery Date (unless such delay is due to Tenant Delays and/or Force Majeure delays). Effective effective upon the Expansion Commencement Date, the Existing Premises shall shall, subject to Section 13 below, be increased to include the Expansion Space. Landlord and Tenant hereby agree that such addition of the Expansion Space to the Existing Premises shall, effective as of the Expansion Commencement DateDate (but subject to Section 13 below), expand increase the Premises number of square feet leased by Tenant in the Building to a total of 214,607 rentable 7,729 square feetfeet of Net Rentable Area (6,472 square feet of Usable Area). Effective as of the Expansion Commencement Date, all references to the “"Premises” " shall mean and refer to the Existing Premises as expanded by the Expansion Space. The anticipated Expansion Commencement Date is February 1, 2003.

Expansion of the Existing Premises. That certain space located on the entire twelfth (12th) floor of the Building consisting of approximately 19,684 rentable square feet known as Suite 1200, as outlined on the floor plan attached hereto as Exhibit "A" and made a part hereof, may be referred to herein as the "Expansion Space." Landlord and Tenant hereby stipulate that for purposes of the Lease (as amended), the Expansion Space shall be deemed to contain 19,684 rentable square feet. Effective one-hundred-twenty as of the date (120) days after Delivery Date (“"Expansion Commencement Date”)") that is the earlier of (a) the date Tenant commences business operations in the Expansion Space, and (b) the date upon which the Expansion Space is Ready for Occupancy, Tenant shall lease from Landlord and Landlord shall lease to Tenant that certain space commonly known as Suite 1300 comprised of 28,799 rentable square feet located on the entire thirteenth (13th) floor and Suite 1400 comprised of 27,983 rentable square feet located on the entire fourteenth (14th) floor of the Building, as outlined on the floor plans attached hereto as Exhibit “A” (the “Expansion Space”); provided. Accordingly, however, that Landlord shall deliver possession of the Expansion Space to Tenant no later than thirty (30) days after the date this Second Amendment is fully executed (“Delivery Date”). In the event Landlord does not deliver possession of the Expansion Space to Tenant on or before the Delivery Date, then Tenant shall be entitled to receive an abatement of Base Rent and Tenant’s Share of Direct Expenses equal to two (2) days for every one (1) day beyond the Delivery Date (unless such delay is due to Tenant Delays and/or Force Majeure delays). Effective effective upon the Expansion Commencement Date, the Existing Premises shall be increased to include the Expansion Space. Landlord and Tenant hereby agree that such addition of the Expansion Space to the Existing Premises shall, effective as of the Expansion Commencement Date, expand increase the Premises number of rentable square feet leased by Tenant in the Building to a total of 214,607 110,462 rentable square feet. The Expansion Commencement Date is anticipated to occur on or about July 1, 2015. Effective as of the Expansion Commencement Date, all references in the Lease or this Second Amendment to the “"Premises” " shall mean and refer to the Existing Premises as expanded by the Expansion Space.

Expansion of the Existing Premises. That certain space located on the first (1st) floor of the Building outlined on the floor plan attached hereto as Exhibit "A" and made a part hereof, may be referred to herein as the "Expansion Space." Landlord and Tenant hereby stipulate that the Expansion Space contains 806 rentable square feet. Effective oneas of the date ("Expansion Commencement Date") which is forty-hundred-twenty two (12042) days after Delivery Date the earlier to occur of (“a) the date of "Substantial Completion" of the "Tenant Improvements" (as those terms are defined in the Tenant Work Letter attached hereto as Exhibit "B") in the Expansion Commencement Date”)Space or (b) the date Tenant first commences to conduct business in the Expansion Space, Tenant shall lease from Landlord and Landlord shall lease to Tenant that certain space commonly known as Suite 1300 comprised of 28,799 rentable square feet located on the entire thirteenth (13th) floor and Suite 1400 comprised of 27,983 rentable square feet located on the entire fourteenth (14th) floor of the Building, as outlined on the floor plans attached hereto as Exhibit “A” (the “Expansion Space”); provided. Accordingly, however, that Landlord shall deliver possession of the Expansion Space to Tenant no later than thirty (30) days after the date this Second Amendment is fully executed (“Delivery Date”). In the event Landlord does not deliver possession of the Expansion Space to Tenant on or before the Delivery Date, then Tenant shall be entitled to receive an abatement of Base Rent and Tenant’s Share of Direct Expenses equal to two (2) days for every one (1) day beyond the Delivery Date (unless such delay is due to Tenant Delays and/or Force Majeure delays). Effective effective upon the Expansion Commencement Date, the Existing Premises shall be increased to include the Expansion Space. Landlord and Tenant hereby agree that such addition of the Expansion Space to the Existing Premises shall, effective as of the Expansion Commencement Date, expand increase the Premises number of rentable square feet leased by Tenant in the Building to a total of 214,607 5,265 rentable square feet. The Expansion Commencement Date is anticipated to occur on or about September 1, 2020. Effective as of the Expansion Commencement Date, all references in the Lease to the “"Premises” " shall mean and refer to the Existing Premises as expanded by the Expansion Space.

Expansion of the Existing Premises. That certain space consisting of the entire second (2nd) floor of the 26672 Building outlined on the floor plan attached hereto as Exhibit “A” and made a part hereof, may be referred to herein as the “Expansion Space.” Landlord and Tenant hereby stipulate that the Expansion Space contains 23,464 rentable square feet and such square footage is not subject to adjustment or re-measurement by Landlord or Tenant, even if the actual rentable square footage of the Expansion Space is more or less than 23,464 rentable square feet. Effective one-hundred-twenty (120) days after Delivery Date as of the date (“Expansion Commencement Date”)) that is the earlier of (a) the date Tenant commences business operations in the Expansion Space, and (b) the date which is one hundred fifty (150) days after the date of full execution and delivery of this First Amendment by Landlord and Tenant, Tenant shall lease from Landlord and Landlord shall lease to Tenant that certain space commonly known as Suite 1300 comprised of 28,799 rentable square feet located on the entire thirteenth (13th) floor and Suite 1400 comprised of 27,983 rentable square feet located on the entire fourteenth (14th) floor of the Building, as outlined on the floor plans attached hereto as Exhibit “A” (the “Expansion Space”); provided. Accordingly, however, that Landlord shall deliver possession of the Expansion Space to Tenant no later than thirty (30) days after the date this Second Amendment is fully executed (“Delivery Date”). In the event Landlord does not deliver possession of the Expansion Space to Tenant on or before the Delivery Date, then Tenant shall be entitled to receive an abatement of Base Rent and Tenant’s Share of Direct Expenses equal to two (2) days for every one (1) day beyond the Delivery Date (unless such delay is due to Tenant Delays and/or Force Majeure delays). Effective effective upon the Expansion Commencement Date, the Existing Premises shall be increased to include the Expansion Space. Landlord and Tenant hereby agree that such addition of the Expansion Space to the Existing Premises shall, effective as of the Expansion Commencement Date, expand increase the Premises number of rentable square feet leased by Tenant in the Project to a total of 214,607 106,299 rentable square feet. Effective as of the Expansion Commencement Date, all references to the “Premises” shall mean and refer to the Existing Premises as expanded by the Expansion Space.

Expansion of the Existing Premises. That certain space located on the second (2nd) floor of the Building consisting of 7,225 rentable square feet designated as Suite 225, as outlined on the floor plan attached hereto as Exhibit "A" and made a part hereof, may be referred to herein as the "Expansion Space." Effective one-hundred-twenty as of the date (120) days after Delivery Date (“the "Expansion Commencement Date”"), which is the earlier of (i) the date Tenant commences business operations in the Expansion Space, or (ii) December 1, 2017, Tenant shall lease from Landlord and Landlord shall lease to Tenant that certain space commonly known as Suite 1300 comprised of 28,799 rentable square feet located on the entire thirteenth (13th) floor and Suite 1400 comprised of 27,983 rentable square feet located on the entire fourteenth (14th) floor of the Building, as outlined on the floor plans attached hereto as Exhibit “A” (the “Expansion Space”); provided. Accordingly, however, that Landlord shall deliver possession of the Expansion Space to Tenant no later than thirty (30) days after the date this Second Amendment is fully executed (“Delivery Date”). In the event Landlord does not deliver possession of the Expansion Space to Tenant on or before the Delivery Date, then Tenant shall be entitled to receive an abatement of Base Rent and Tenant’s Share of Direct Expenses equal to two (2) days for every one (1) day beyond the Delivery Date (unless such delay is due to Tenant Delays and/or Force Majeure delays). Effective effective upon the Expansion Commencement Date, the Existing Premises shall be increased to include the Expansion Space. Landlord and Tenant hereby agree that such addition of the Expansion Space to the Existing Premises shall, effective as of the Expansion Commencement Date, expand increase the Premises number of rentable square feet leased by Tenant in the Building to a total of 214,607 31,142 rentable square feet. Effective as of the Expansion Commencement Date, all references to the “"Premises” " shall mean and refer to the Existing Premises as expanded by the Expansion Space.

Expansion of the Existing Premises. Effective one-hundred-twenty That certain space located on the second (1202nd) days after Delivery Date floor of the Building consisting of the remaining 6,011 rentable square feet is referred to herein as the “Expansion Space.” Tenant shall lease the Expansion Space effective as of the date hereof (“Expansion Commencement Date”), Tenant shall lease from Landlord and Landlord shall lease to Tenant that certain space commonly known as Suite 1300 comprised of 28,799 rentable square feet located on the entire thirteenth (13th) floor and Suite 1400 comprised of 27,983 rentable square feet located on the entire fourteenth (14th) floor of the Building, as outlined on the floor plans attached hereto as Exhibit “A” (the “Expansion Space”); provided, however, that Landlord shall deliver possession of however Tenant will not be obligated to pay Rent for the Expansion Space to Tenant no later than thirty (30) days after the date this Second Amendment is fully executed (“Delivery Date”)until June 1, 2011, as provided in Section 4 below. In the event Landlord does not deliver possession of the Expansion Space to Tenant on or before the Delivery DateAccordingly, then Tenant shall be entitled to receive an abatement of Base Rent and Tenant’s Share of Direct Expenses equal to two (2) days for every one (1) day beyond the Delivery Date (unless such delay is due to Tenant Delays and/or Force Majeure delays). Effective effective upon the Expansion Commencement Date, the Existing Premises shall be increased to include the Expansion Space. Expansion of the Existing Premises. Landlord and Tenant hereby agree that such addition of the Suite 320 Expansion Space to the Existing Premises shall, effective as of the Suite 320 Expansion Commencement Date, expand increase the Premises number of square feet leased by Tenant in the Building to a total of 214,607 rentable 127,633 square feetfeet of Net Rentable Area (000,000 xxxxxx xxxx xx Xxxxxx Xxxx). Effective as of the Suite 320 Expansion Commencement Date, all references to the “Premises” shall mean and refer to the Existing Premises as expanded by the Suite 320 Expansion Space.

Expansion of the Existing Premises. Effective one-hundred-twenty (120) days after Delivery Date All of the space located in the 10260 Building located in the Project, as outlined on the plan attached hereto as Exhibit “A” and made a part hereof, may be referred to herein as the “Expansion Space.” The Expansion Space contains approximately 36,985 rentable square feet. Subject to satisfaction of the Contingency described in Section 13 below, effective as of December 30, 2004 (“Expansion Space Commencement Date”), Tenant shall lease from Landlord and Landlord Land lord shall lease to Tenant that certain space commonly known as Suite 1300 comprised of 28,799 rentable square feet located on the entire thirteenth (13th) floor and Suite 1400 comprised of 27,983 rentable square feet located on the entire fourteenth (14th) floor of the Building, as outlined on the floor plans attached hereto as Exhibit “A” (the “Expansion Space”); provided. Accordingly, however, that Landlord shall deliver possession of effective upon the Expansion Space to Tenant no later than thirty (30) days after the date this Second Amendment is fully executed (“Delivery Date”). Landlord and Tenant hereby agree that such addition of the Expansion Space to the Existing Premises shall, effective as of the Expansion Space Commencement Date, expand increase the Premises number of rentable square feet leased by Tenant in the Project to a total of 214,607 105,719 rentable square feet. Effective as of the Expansion Space Commencement Date, except as otherwise described herein, all references to the “Premises” in this Third Amendment and in the Lease shall mean and refer to the Existing Premises as expanded by the Expansion Space.

Expansion of the Existing Premises. That certain space located on the second (2nd) floor of the Building and known as Suite 220 outlined on the floor plan attached hereto as Exhibit "A" and made a part hereof, is referred herein as the "First Expansion Space." Landlord and Tenant stipulate that the First Expansion Space contains 2,827 rentable square feet. Effective one-hundred-twenty as of the date (120) days after Delivery Date (“"First Expansion Commencement Date”") that is the later of (i) the date Landlord obtains possession of the First Expansion Space from the Current Tenant (as defined in Section 15 below), and (ii) March 1, 2006, Tenant shall lease from Landlord and Landlord shall lease to Tenant that certain space commonly known as Suite 1300 comprised of 28,799 rentable square feet located on the entire thirteenth (13th) floor and Suite 1400 comprised of 27,983 rentable square feet located on the entire fourteenth (14th) floor of the Building, as outlined on the floor plans attached hereto as Exhibit “A” (the “First Expansion Space”); provided, however, that if the First Expansion Commencement Date has not occurred by June 1, 2006, Tenant shall have the right, upon written notice to Landlord shall deliver possession of delivered any time after June 1, 2006 until the date Landlord delivers the First Expansion Space to Tenant no later than thirty (30) days after Tenant, to terminate the date this Second Amendment is fully executed (“Delivery Date”).
