Expansion Premises A. Landlord hereby demises and leases to Tenant, and Tenant hereby hires and takes from Landlord, Expansion Premises A. Said demise of Expansion Premises A shall be for a term commencing on the date Landlord delivers Expansion Premises A to Tenant, in its as-is condition, broom-clean, with all Building systems in good working order and free and clear of all occupants (the “Expansion Premises A Commencement Date”), which date is estimated to occur on January 1, 2015 (the “Estimated Expansion Premises A Commencement Date”) and expiring on the Extended Termination Date. Landlord shall use diligent efforts to deliver Expansion Premises A to Tenant on or before the Estimated Expansion Premises A Commencement Date; however, the failure of Landlord to deliver Expansion Premises A on or before the Estimated Expansion Premises A Commencement Date shall in no way affect the validity of the Lease, this First Amendment, or the obligations of Tenant hereunder, and Tenant shall not have any claim against Landlord by reason thereof. The “Expansion Premises A Rent Commencement Date” shall be the date that is sixty (60) days after the earlier to occur of (i) the date that is sixty (60) days following the Expansion Premises A Commencement Date or (ii) the date on which Tenant’s personnel shall occupy all or any part of Expansion Premises A for the conduct of its business. After the Expansion Premises A Commencement Date and the Expansion Premises A Rent Commencement Date have occurred, the parties shall, upon the written request of either party, execute an agreement confirming such dates.
Expansion Premises A. As soon as is reasonably practical, Landlord shall (i) cut two (2) openings in the demising wall separating the Current Premises and Expansion Premises A at the locations to be mutually agreed upon by Landlord and Tenant, (ii) seal the warehouse floor in Expansion Premises A, (iii) cause the electric utilities to be separately metered, (iv) provide lighting to 30 foot candles throughout the unracked shell Expansion Premises A, and (v) fill or smooth the transition floor located at the two (2) openings in the demising wall to industry standards.
Expansion Premises A. Retroactively effective as of January 1, 2013, the Current Premises shall be expanded to include that certain space located in the Building which consists of the approximately 140,548 square foot area (“Expansion Premises A”) labeled as “Expansion Premises A” on the site plan (“Site Plan”), which Site Plan is attached as Exhibit A hereto, and all references in the Lease to the “Premises” from and after January 1, 2013 shall mean the Current Premises expanded to include Expansion Premises A. Base Rent and Additional Rent applicable to Expansion Premises A shall begin to accrue effective as of January 1, 2013. From and after January 1, 2013, ▇▇▇▇▇▇’s Share shall be increased to 82.3%.
Expansion Premises A. Section 2B(i) of the First Amendment is hereby deleted in its entirety, and the below-listed Base Rent chart is hereby substituted therefor: (i) Base Rent.
