Common use of Expansion Space Clause in Contracts

Expansion Space. That certain space located on the third (3rd) floor of the 26672 Building currently known as Suites 300 and 305, as outlined on the floor plan attached hereto as EXHIBIT A, shall be referred to herein, collectively, as the “Expansion Space.” Landlord and Tenant hereby stipulate that the Expansion Space contains a total of 5,903 rentable square feet, which is comprised of 2,395 rentable square feet currently known as Suite 305 (“Suite 305 Portion”) and 3,508 rentable square feet currently known as Suite 300 (“Suite 300 Portion”), and such square footages are not subject to adjustment or re-measurement by Landlord or Tenant, even if the actual rentable square footage of the Expansion Space is more or less than 5,903 rentable square feet. Tenant shall lease the Expansion Space and commence to pay charges for the Expansion Space pursuant to the Lease, as hereby amended, effective as of the later of (i) April 1, 2014, or (ii) the completion of the Improvements (as that term is defined in Section 6 below), other than the Suite Configuration Work, pursuant to Section 6 below (“Expansion Commencement Date”). The addition of the Expansion Space to the Existing Premises shall, effective as of the Expansion Commencement Date, increase the number of rentable square feet leased by Tenant in the Development to a total of 121,402 rentable square feet. Effective as of the Expansion Commencement Date, all references to the “Premises” shall mean and refer to the Existing Premises as expanded by the Expansion Space.

Expansion Space. Tenant shall lease the Expansion Space and commence to pay charges for the Expansion Space pursuant to the Lease, as hereby amended, effective as of the later of (i) April July 1, 2014, or (ii) the completion of the Improvements (as that term is defined in Section 6 below), other than the Suite Configuration Work, pursuant to Section 6 below ) (“Expansion Commencement Date”); provided, however, that Landlord shall provide Tenant with access to the Expansion Space upon full execution and delivery of this Fourth Amendment by Landlord and Tenant for the purposes of installing Tenant’s furniture, fixtures, and equipment and Tenant’s telephone, network, and data cabling, and Tenant shall have no obligation to pay Basic Rental with respect to the Expansion Space during the period of such access.; provided, however, that (i) Tenant’s access shall not interfere with Landlord’s completion of the Improvements, (ii) Tenant shall provide a certificate of insurance in accordance with Article 14 of the Original Lease for the Expansion Space prior to such entry, and (iii) the terms and conditions of Section 13(a) of the Original Lease shall apply to such access by Tenant. The addition of the Expansion Space to the Existing Premises shall, effective as of the Expansion Commencement Date, increase the number of rentable square feet leased by Tenant in the Development to a total of 121,402 127,720 rentable square feet. Expansion Space. That certain space located Effective on the third (3rd) floor date of substantial completion of each of the 26672 Building currently known as referenced suites, Suites 300 410 (consisting of approximately 2,562 rentable square feet), 430 (consisting of approximately 508 rentable square feet), 440 (consisting of approximately 963 rentable square feet), 710 (consisting of approximately 2,401 rentable square feet), 750 (consisting of approximately 1,719 rentable square feet), 760 (consisting of approximately 3,959 rentable square feet), and 305, as outlined on the floor plan attached hereto as EXHIBIT A, shall be referred to herein, collectively, as the “Expansion Space.” Landlord and Tenant hereby stipulate that the Expansion Space contains Suite 790 (consisting of approximately 1,279 rentable square feet) comprising a total of 5,903 approximately 13,391 rentable square feet in the Building, on the area indicated on the site plan on Exhibit A, which is attached hereto and incorporated herein, (collectively referred to herein from time to time as the "Expansion Space") shall be added to the Initial Premises so that as of the completion of the Expansion Space, the "Premises" (as defined in the Lease) shall consist of approximately 54,377 rentable square feet, . "Substantial completion" of the Tenant Improvements shall mean the date on which is comprised of 2,395 rentable square feet currently known the Tenant Improvements set forth in the Plan (as Suite 305 (“Suite 305 Portion”defined hereinafter) and 3,508 rentable square feet currently known as Suite 300 (“Suite 300 Portion”)are completed, and such square footages are not subject to adjustment or re-measurement by Landlord or Tenant, even if the actual rentable square footage individual suite of the Expansion Space is more available for Tenant's occupancy, subject only to the completion of minor or less than 5,903 rentable square feetinsignificant details of finish construction, decoration or mechanical adjustments which do not materially interfere with Tenant's conduct of business. Tenant shall execute Landlord's standard Confirmation of (i) April 1Commencement Agreement, 2014in the form attached hereto as Exhibit B, or (ii) the completion of the Improvements (as that term is defined in Section 6 below), other than the Suite Configuration Work, pursuant to Section 6 below (“Expansion Commencement Date”). The addition for each suite of the Expansion Space to set forth the Existing Premises shall, effective as Commencement Date and term of the Expansion Commencement Date, increase the number of rentable square feet leased by Tenant in the Development to a total of 121,402 rentable square feet. Effective as of the Expansion Commencement Date, all references to the “Premises” shall mean and refer to the Existing Premises as expanded by the Expansion SpaceLease for each respective suite.

Expansion Space. That Subject to the terms and conditions contained in the following sections, Lessee shall be obligated to lease that certain space located on contiguous to the third Premises known as Suite 325 which contains approximately 1,308 rentable square feet (3rdthe "Expansion Space") floor as soon as it becomes available to Lessor for leasing. 34.1 Whenever the current tenant of the 26672 Building currently known as Suites 300 and 305, as outlined on Expansion Space vacates the floor plan attached hereto as EXHIBIT A, shall be referred to herein, collectively, as the “Expansion Space.” Landlord and Tenant hereby stipulate same such that the Expansion Space contains is available to Lessor to re-lease, Lessor shall notify Lessee in writing that the Expansion Space is available. Within ten (10) days after receiving such notice, Lessee shall execute a total lease amendment in the form attached hereto and incorporated herein by this reference as Exhibit "D." 34.2 The effective date of 5,903 rentable square feet, which is comprised Lessee's leasing of 2,395 rentable square feet currently known the Expansion Space shall be the date Lessor delivers the Expansion Space to Lessee with the Expansion Improvements (as Suite 305 defined in Section 34.3 below) substantially complete. Lessor shall give Lessee ten (“Suite 305 Portion”10) days' prior notice of the date that Lessor anticipates completing the Expansion Improvements and 3,508 rentable square feet currently known as Suite 300 (“Suite 300 Portion”)delivering the Expansion Space to Lessee. Lessee's leasing of the Expansion Space shall be for the same term, and upon the same terms, covenants, and conditions set forth in this Lease, except as follows: (i) Base Monthly Rental shall be increased by an amount equal to the then-applicable per square foot rental rate set forth in Section 3.1.1 of this Lease (or otherwise calculable based on the monthly figures set forth in such square footages are not subject to adjustment or re-measurement section) multiplied by Landlord or Tenant1,308, even provided, however, if the actual rentable effective date of Lessee's leasing of the Expansion Space shall occur prior to September 1, 2000, Base Monthly Rental owing under this Lease from such effective date through August 31, 2000, shall be increased by an amount equal to One and 95/100 Dollars ($1.95) multiplied by 1,308, and thereafter increased in accordance with the table set forth in Section 3.1.1 of this Lease. (ii) Lessee's pro rata share of Operating Expenses, as set forth in Section 11.3 of this Lease, shall be increased by a percentage determined by multiplying 100 times the result of dividing the square footage of the Expansion Space is more or less than 5,903 by the rentable square feet. Tenant shall lease the Expansion Space and commence to pay charges for the Expansion Space pursuant to the Lease, as hereby amended, effective as area of the later of (i) April 1, 2014, or (ii) the completion of the Improvements (as that term is defined in Section 6 below), other than the Suite Configuration Work, pursuant Building. 34.3 Prior to Section 6 below (“Expansion Commencement Date”). The addition delivering possession of the Expansion Space to the Existing Premises Lessee, Lessor shall, effective at its sole cost and expense, complete those mutually agreed upon improvements set forth in the plans and specifications attached hereto and incorporated herein by this reference as Exhibit "I" (the "Expansion Improvements"). If Tenant makes any changes to the plans and specifications attached hereto that results in an increase in Lessor's costs to complete the Expansion Improvements, Lessee shall be solely responsible for such increased costs and shall reimburse Lessor for such increased costs upon receipt from Lessor of evidence of such increased costs. Other than the Expansion Improvements to be completed by Lessor, Lessee agrees to accept possession of the Expansion Commencement Date, increase the number of rentable square feet leased by Tenant Space in the Development to a total of 121,402 rentable square feet. Effective as of the Expansion Commencement Date, all references to the “Premises” shall mean and refer to the Existing Premises as expanded by the Expansion Spaceits then-existing "as-is" condition."
