Common use of Expenses and Attorneys’ Fees Clause in Contracts

Expenses and Attorneys’ Fees. In the event that a dispute arises under this Agreement that results in litigation or arbitration, the prevailing party, as determined by the decision of a court or forum of competent and final jurisdiction, shall be entitled to court costs and reasonable attorney's fees. A court or forum of "final" jurisdiction shall mean a court of forum from which no appeal may be taken or from whose decree, decision, judgment, or order no appeal is taken or prosecuted.
