Common use of Experimental or Cosmetic Procedures Clause in Contracts

Experimental or Cosmetic Procedures. In no instance shall the Contractor be required to pay Claims for experimental or cosmetic procedures, except as required by the Puerto Rico Patient’s Xxxx of Rights Act or any other federal or Puerto Rico law or regulation. As provided in Section 7.5.6.2 of this Contract, breast reconstruction after a mastectomy and surgical procedures that are determined to be Medically Necessary to treat morbid obesity shall not be regarded as cosmetic procedures.
