Expert Witness. Preparing to serve or serving as an expert witness in connection with any arbitration proceeding or legal proceeding, providing, however, that Consultant cannot testify against City in any proceeding during the course of this Agreement.
Expert Witness. Any unit member accepting appointment as an expert 16 witness in any court or administrative agency hearing where the unit member has volunteered 17 his/her services for the purpose of testifying as an expert witness, shall be allowed to retain 18 his/her expert witness fees. The unit member, however, shall not be allowed to charge any day 19 of absence to this leave provision. Instead, the unit member shall be required to take an unpaid 20 leave of absence.
Expert Witness. Preparing to serve or serving as an expert witness in connection with any public hearing or legal proceeding.
Expert Witness has the sole right to control and direct the means, manner, and method by which the Services required under this Agreement will be performed; Expert Witness shall select the routes taken, starting and ending times, days of work, and order the work that performed;
Expert Witness. Providing services as an expert witness in connection with a public hearing, arbitration or other legal proceeding arising out of an Assigned Project, except where Consultant is a party thereto, is called as a percipient witness (in which case Consultant will be entitled to witness fees and costs as allowed by law) or is found liable for damages or other relief.
Expert Witness. Assistance to the Owner as expert witness in any litigation with third parties, arising from the development or construction of the Project.
Expert Witness. 13.1. If requested by the County, the Consultant shall serve as an expert or professional witness for the County in any legal proceedings arising in connection with this Contract. The expert or professional witness fee for Consultant shall be a reasonable rate negotiated at the time the Consultant is called for such a duty.
Expert Witness. Advice, assistance and possible court and administrative hearing appearance(s) regarding legal matters. General Requirements for Services Include:
1) Provide survey deliverables on DVD or other CITY requested medium in either AutoCad Design File format together with ASCII point file information in a format using a standard set of feature codes as provided or identified by the CITY. Provide all deliverables according to CADD standards provided or identified by the CITY.
2) Provide all survey deliverables using State Plane Coordinates and reference CITY benchmarks or other published controls that may be specified as part of the scope of work, unless specifically authorized to use assumed elevations.
3) All information collected and provided through the AGREEMENT will be the property of the CITY. Unless otherwise required by law or lawful order of a court or regulatory body of applicable jurisdiction, no data is to be released by the CONSULTANT to any other entity other than the City unless the City provides written permission to release such data.
4) Staff performing surveying and mapping work on City projects shall be Florida licensed Surveyors and Mappers, as applicable and as required by law, and the other staff members shall be Certified Survey Technicians registered by the National Society of Professional Surveyors and American Congress on Surveying and Mapping, with each individual staff member’s level of certification conforming to the tasks being performed by such individual as defined in the certification criteria.
Expert Witness. Experience in specialized areas of regulatory and rate case analysis and the preparation and provision of expert testimony in regulatory proceedings; experience in analyzing regulatory filings and presenting testimony as an expert witness on behalf of large industrial and commercial end users.
Expert Witness. Expert witness and certificate (merit or lender) duties will be billed at a rate of $425.00/hour.
