EXPIRATION OF COMPANY'S REPURCHASE RIGHT. The Repurchase Right of the Company set forth in this Section 17 shall remain in effect until such time, if ever, as an underwritten public offering is made of shares of the Company's Common Stock pursuant to a registration statement filed under the Securities Act or any successor statute, at which time this Section 17 and the Repurchase Right set forth herein will automatically terminate.
