Common use of Extended Term Gathering Fee Clause in Contracts

Extended Term Gathering Fee. Upon expiration of the Primary Term, Gatherer and Anchor Shippers will attempt to agree on a new fixed Gathering Fee during the Extended Term. If such parties cannot agree, the Gathering Fee during the Extended Term will be the average of the Gathering Fee for the final three (3) years of the Primary Term and will be subject to annual escalation by the Inflation Factor as defined in Section 4.5.
