Common use of Extensive Damage Clause in Contracts

Extensive Damage. 1. In the event that all or a portion of the Premises are destroyed by fire, explosion, the elements, the public enemy or other casualty, or so damaged that they are untenable and cannot reasonably be repaired within thirty (30) days, the Aviation Authority shall be under no obligation to repair, replace or reconstruct the Premises. This Minimum Annual Concession Fees and utilities charges payable by Company to the Aviation Authority hereunder shall xxxxx as of the time of such damage or destruction and shall henceforth cease until such time as said Premises are restored so as to render the Premises tenable or the Aviation Authority elects to terminate this Agreement by written notice to Company.
