Common use of Extent of Exculpation; Enforcement of Rights Clause in Contracts

Extent of Exculpation; Enforcement of Rights. The exculpation provision set forth in Section 14.2 hereof shall apply to all types of claims or actions including, but not limited to, claims or actions based on contract or tort. Notwithstanding the foregoing, Purchaser may protect and enforce its rights under this Agreement by a suit or suits in equity for specific performance of any obligations or duty of SCPPA and Purchaser shall at all times retain the right to recover, by appropriate legal proceedings, any amount determined to have been an overpayment by Purchaser in accordance with Section 7.4 hereof.

Notwithstanding the foregoing, Purchaser Participant may protect and enforce its rights under this Agreement by a suit or suits in equity for specific performance of any obligations or duty of SCPPA and Purchaser Participant shall at all times retain the right to recover, by appropriate legal proceedings, any amount determined to have been an overpayment by Purchaser Participant in accordance with Section Sections 6.9 and 7.4 hereof.
