EXTENT OF GOVERNMENT OBLIGATION. The placement of the listed pharmaceutical agent(s) in the UF is not worse than the formulary (2nd) cost share tier in accordance with the final decision of the Director, DHA, is a condition of receiving refunds under this Agreement. This Agreement imposes no obligation on the DoD to purchase any product.
