An Extenuating Circumstance clause allows for exceptions to contractual obligations when unforeseen or extraordinary events occur that are beyond the control of the parties involved. Typically, this clause applies in situations such as natural disasters, serious illness, or other emergencies that prevent a party from fulfilling their duties under the agreement. Extenuating Circumstance. Circumstances that by their serious, unpredictable, or uncontrollable nature warrant an exception to the policies in place.
Extenuating Circumstance. “Extenuating Circumstance” means an event of force majeure as set forth in §14.3 of this Agreement or any excused failure by COLOPLAST or RMC to perform under this Agreement as set forth in §8 hereof.
