Common use of Facilities Operation Clause in Contracts

Facilities Operation. The Grantee shall operate and maintain all facilities to which the general public has right of access constructed under the auspices of this Contract in accordance with minimum standards as may be required or prescribed by the applicable Federal, State and local statute, law, ordinance, or regulation as to actual construction procedures. The Grantee shall be responsible for maintenance and operation of such facilities upon completion. The Grantee may not change the use or planned use of any such facility (including the beneficiaries of such use) from that purpose initially approved unless the Grantee provides affected citizens with reasonable notice thereof and opportunity to comment on any proposed change all in accordance with 24 CFR Part 570.489(j). The subrecipient must develop a plan for the long-term operation and maintenance of the infrastructure projects. The subrecipient must have a plan for the useful life of the infrastructure as documentation which must include a yearly funding proposed budget. Funding options might include State or local resource, borrowing authority, or retargeting of existing financial resources in accordance with 84 FRN 45838 V.A.13a.(i).
