Facilities Under CAISO Operational Control. Parties shall identify on Schedule 1 those facilities of the UDC that the Parties mutually agree will be placed under the CAISO’s Operational Control pursuant to the CAISO Tariff. In the event that a Party invokes the dispute resolution provision identified in Section 7.1 of this Operating Agreement, such dispute shall be resolved based upon whether the CAISO’s control over such disputed facilities is essential to meeting the Applicable Reliability Criteria, as defined in the CAISO Tariff. With respect to each facility identified in Schedule 1, the Parties shall negotiate the extent of the CAISO’s Operational Control in order to meet said standard.
