Common use of Facility Trade Names Clause in Contracts

Facility Trade Names. If this Lease is terminated after the occurrence of an Event of Default, Lessee shall be deemed to have assigned to Lessor the exclusive right to use the Facility Trade Names in perpetuity in the markets in which the Facilities are located, and Lessee shall not after any such termination use the Facility Trade Names in any business that competes with the Facilities.

Facility Trade Names. If this Lease is terminated after the occurrence in any respect as a result of an Event of DefaultLessee’s default, Lessee Lessor shall be deemed to have assigned to Lessor the exclusive right permitted to use the name(s) under which the Property has done business during the Term (the “Facility Trade Names in perpetuity in the markets in which the Facilities are located, and Names”). Lessee shall not after any such termination use the any Facility Trade Names Name in the same market in which the applicable Property is located in connection with any business that competes with the Facilitiessuch Property.

If this Lease is terminated after the occurrence because of an Event of Default, Lessee or Lessor exercises its option to purchase Lessees' Personal Property pursuant to Section 36.1, Lessor shall be deemed to have assigned to Lessor the exclusive right permitted to use the name under which each Facility has done business during the Term (the "Facility Trade Names in perpetuity in the markets in which the Facilities are located, and Lessee Names"). Lessees shall not after any such termination use any Facility Trade Name in the same market in which the Facility Trade Names is located in connection with any business that competes with the Facilitiessuch Facility.
