Common use of Failure to Advance the Process Clause in Contracts

Failure to Advance the Process. Failure to advance the process within the time specified in Section 3.4 will be deemed a waiver of any right to contest an action covered by this procedure with respect to the specific action at issue and will forever bar any claim or proceeding related to such action. In other words, if a party fails to advance the process within the time specified, that party has no right to complain that the process has moved ahead. However, notwithstanding this provision, the parties may agree in writing to extend any of the time limits for a specified period.
