Failure To Convert Non. Impaired Services – DS1 and DS3 E-XXXX and M- XXXX. Absent CLEC transition of DS1 and DS3 E-XXXX and M-XXXX within ninety (90) days of Execution of this Amendment, Qwest will convert facilities to month to month service arrangements in Qwest’s Special Access Tariff and CLEC is subject to back billing for the difference between the rates for the UNEs and rates for the Qwest alternative service arrangements to the 91st day. CLEC is also responsible for all non- recurring charges associated with such conversions.
