Common use of Failure to Exercise Rights Clause in Contracts

Failure to Exercise Rights. 17.1 No failure of the Licensor to exercise any right given to it hereunder, or to insist upon strict compliance with any obligation or condition hereunder, and no custom or practice of the parties at variance with the terms hereof, shall constitute a waiver by the Licensor of its right to demand exact and strict compliance with the terms of this Agreement. Any delay or failure by the Licensor in exercising any rights arising from a default under, or breach of, this Agreement shall not affect or impair the rights of the Licensor as to said default or breach, or any subsequent default or breach.
