Common use of Failure to Object to Settlement Clause in Contracts

Failure to Object to Settlement. Class Members who fail to object to the 14 Settlement Agreement in the manner specified above will: (1) be deemed to have 15 waived their right to object to the Settlement Agreement; (2) be foreclosed from 16 objecting (whether by a subsequent objection, intervention, appeal, or any other 17 process) to the Settlement Agreement; and (3) not be entitled to speak at the Fairness 18 Hearing.
