Failure to pay the Amounts Payable. Without prejudice to Xxxxxxx’x other rights or remedies available under the Contract (including under Clause 9.4), Sandvik: (a) may without prior notice to the Purchaser suspend or terminate: (i) the supply of Goods, Services, or Digital Services; and (ii) the grant of any rights or licences with respect to the Goods, Services, or Digital Services, where any Amount Payable is or remain(s) unpaid after the Due Date; and (b) shall be entitled to recover from the Purchaser all reasonably incurred costs and losses arising from suspension or termination.
